Terms of Service

Welcome to LidoLink! Before you access our services, please read these Terms of Service.

These Terms of Service ("Terms") govern your use of LidoLink's voice-based AI restaurant reservation platform, along with any associated apps, software, and websites (together, our "Services"). These Terms are a contract between you and LidoLink.

In these Terms, when we refer to "we", "us" or "our," or similar, we mean LidoLink. Other words in bold and inverted commas have the meaning given to them where the word or phrase is first used. Subsequent uses of these words have the same meaning.

By accessing our Services, you agree to these Terms. Please also read our Privacy Policy, which describes how we collect and use personal information.

1. Who We Are

LidoLink is Italy's first voice-based AI platform designed to make restaurant reservations effortless. We use advanced artificial intelligence to understand your dining preferences, find available restaurants, and handle the entire booking process through natural voice interactions. Our state of the art technology transforms how people discover and book dining experiences across Italy.

2. Account Creation and Access

Minimum Age

You must be at least 13 years old or the minimum age required to consent to use the Services in your location, whichever is higher.

Your LidoLink Account

To access our Services, you'll create an account ("Account") using your existing Google or Microsoft credentials. We don't require separate passwords or additional email creation. When you authenticate through these services, we collect and store:

  • Your full name
  • Email address
  • Profile picture
  • Phone number (which you'll provide for reservation confirmations and security purposes)

You agree to provide correct, current, and complete Account information and allow us to use it to communicate with you about our Services.

You may not share your Account login information with anyone else, and you are responsible for all activity occurring under your Account. You agree to notify us immediately if you become aware of any unauthorized access by contacting s.showmma@studenti.uniba.it.

You may close your Account at any time by contacting us at s.showmma@studenti.uniba.it.

3. Use of Our Services

You may access and use our Services only in compliance with these Terms and any guidelines or supplemental terms we may post on the Services (the "Permitted Use"). You are responsible for all activity under your Account.

You may not access or use, or help another person to access or use, our Services in the following ways:

  • In any manner that violates any applicable law or regulation, including data protection laws
  • To develop any products or services that compete with our Services or to reverse engineer our AI technology
  • To provide false information for reservations or to make fraudulent bookings
  • To abuse, harm, interfere with, or disrupt our Services, including introducing viruses or attempting to access unauthorized areas
  • To use our Services for any illegal or harmful purpose
  • To violate restaurants' policies or repeatedly fail to honor confirmed reservations

4. Voice Recordings and AI Interactions

Voice Data Collection

During your interactions with our AI, we store your voice conversations ("Voice Recordings"). We use Voice Recordings to:

  • Process your restaurant reservation requests
  • Verify your identity and prevent unauthorized access
  • Improve our AI's ability to understand and respond to user requests
  • Analyze service quality and enhance the user experience
  • Provide customer support when needed
  • Develop and train our AI models for better performance

AI Responses and Actions

Our AI generates responses and takes actions (such as making reservations) based on your voice inputs. You acknowledge that:

  • AI responses may not always be perfectly accurate
  • Restaurant availability and information may change between booking and dining
  • You should confirm important reservation details independently
  • Our AI operates with current technology limitations

5. Location and Personal Data

Location Information

With your permission, we may collect your real-time location to suggest nearby restaurants and provide relevant search results. You can disable location sharing in your device settings, though this may limit our ability to provide location-based recommendations.

Data Processing Rights

Under GDPR and Italian data protection law, you have the right to:

  • Access your personal data
  • Rectify inaccurate information
  • Request deletion of your data
  • Object to processing
  • Data portability
  • Withdraw consent at any time

6. Restaurant Reservations and Information Sharing

Reservation Process

When you make a reservation through LidoLink, we share necessary information with the restaurant including:

  • Your name and phone number
  • Party size and special requests
  • Reservation date and time
  • Any dietary preferences or accessibility needs

Restaurant Responsibility

While we facilitate reservations, the actual dining experience, food quality, service, and restaurant policies are the restaurant's responsibility. We are not liable for restaurant-related issues.

Cancellation Policies

Each restaurant has its own cancellation and modification policies. You are responsible for understanding and complying with these policies.

7. Fees and Payment

Currently, LidoLink's basic reservation service is free for users. We may introduce premium features or subscription services in the future, for which we will provide clear pricing and terms before any charges apply.

8. General Terms

Changes to Services

Our Services are innovative and will evolve. We may sometimes add or remove features, increase or decrease capacity limits, offer new Services, or discontinue certain Services. We may modify, suspend, or discontinue the Services or your access to the Services.

Where feasible, we will provide you with at least 30 days' advance notice of any changes to the Services that would materially limit or reduce the features, availability or functionality of the Services. However, there may be urgent situations (such as preventing abuse, responding to legal requirements, or addressing security and operability issues) where providing advance notice is not feasible.

Changes to These Terms

We may revise and update these Terms. For example, we may update these Terms (1) to reflect changes in our Services, like when we add or remove features, (2) for security or legal reasons, or (3) to promote safety or prevent abuse.

We will notify you of changes to the Terms which are reasonably likely to affect your use of the Services or legal rights. These changes will come into effect no less than 30 days from when we notify you, unless the change is due to a change in law or for security reasons (in which case we may need to change the Terms on shorter notice).

If you do not wish to continue using our Services following any changes to the Terms, you can terminate these Terms by notifying us at s.showmma@studenti.uniba.it before the changes take effect.

Supplemental Terms

We may also post supplemental terms for specific services or features. If you use those services or features, you agree to comply with any applicable supplemental terms ("Supplemental Terms"). If these Terms conflict with Supplemental Terms, the Supplemental Terms will govern for the applicable Service.

9. Third-Party Services and Integrations

Our Services may integrate with third-party services, including restaurant booking systems, mapping services, and payment processors. We do not control these third-party services and are not responsible for their functionality, availability, or policies. Your use of any third-party services is subject to their respective terms and privacy policies.

10. Data Security and International Transfers

We implement appropriate technical and organizational measures to protect your personal data, including encryption and secure data storage. However, no system is completely secure, and we cannot guarantee absolute security.

As we operate across borders, your data may be transferred to and processed in countries outside Italy, including countries that may have different data protection standards. We ensure appropriate safeguards are in place for such transfers in compliance with GDPR.

11. Disclaimer of Warranties, Limitations of Liability, and Indemnity

Our team works hard to provide great services, and we're continuously working on improvements. However, there are certain aspects we can't guarantee.

No Warranties

You may have legal rights in relation to our Services under consumer protection laws. Other than those legal rights, your use of the Services is solely at your own risk. The Services are provided on an "as is" and "as available" basis and, to the fullest extent permissible under applicable law, are provided without warranties of any kind, whether express, implied, or statutory.

No Limitation

Nothing in these Terms excludes or limits our liability for:

  1. Death or personal injury caused by our negligence
  2. Fraud or fraudulent misrepresentation
  3. Any matter in respect of which it would be unlawful for us to exclude or restrict our liability, including your consumer rights under Italian and EU law

Foreseeable Loss

Except as set out above, we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it was an obvious consequence of our breach or if it was contemplated by you and us when you agreed to these Terms.

Indemnification

You agree to indemnify and hold us harmless from any claims, damages, expenses (including reasonable attorney fees), and losses arising from your breach of these Terms, your use of the Services, or your violation of applicable law or third-party rights.

12. Termination

You may stop using LidoLink at any time by deleting your Account. We may suspend or terminate your access to the Services if you violate these Terms or for other legitimate reasons. Upon termination, we may delete your Account data, though some information may be retained as required by law or for legitimate business purposes.

13. Legal Compliance and Dispute Resolution

Governing Law

These Terms are governed by Italian law and EU regulations, including GDPR.

Jurisdiction

Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts of Bari, Italy.

Data Protection Authority

You have the right to lodge a complaint with the Italian Data Protection Authority (Garante per la Protezione dei Dati Personali) regarding our processing of your personal data.
